Legal Aid

Legal Aid Ontario (LAO) is the provincial agency that funds legal representation for people who cannot afford a lawyer. In criminal cases, Legal Aid provides certificates that cover the cost of retaining a private criminal defence lawyer, as well as funding duty counsel services at courthouses across the province.

Eligibility for a Legal Aid certificate is based on financial need and the seriousness of the charge. Generally, applicants must demonstrate that their income falls below a threshold and that they face a real possibility of incarceration, loss of livelihood, or other serious consequences. For very serious charges — such as murder, sexual assault, and other offences on the Extremely Serious Matters (ESM) panel — Legal Aid provides enhanced funding and requires lawyers with specific expertise and experience.

Applying for Legal Aid should be done promptly after being charged. Processing times can vary, and having a certificate in place before your first court appearance allows your lawyer to begin reviewing disclosure and preparing your defence immediately. Not all criminal defence lawyers accept Legal Aid certificates, but many experienced defence lawyers do.
